This is one of the most common questions we hear — and the answer is nuanced. Ireland doesn't automatically recognise the tax-deferred status of US retirement accounts. How your 401(k) or IRA is treated depends on when you draw it down, your residency status, and whether the US–Ireland tax treaty has been properly applied.
Not necessarily — there is a tax treaty between Ireland and the United States designed to prevent double taxation. However, the treaty has to be applied correctly and in the right order. Many people assume it works automatically and end up overpaying.
Split-year relief allows you to be treated as Irish tax resident from the date you arrive, rather than for the full tax year. This can significantly reduce your Irish tax bill in your first year back. It must be claimed and the conditions must be met before or around the time you arrive.
For individuals who are non-domiciled in Ireland, foreign income and gains not brought into Ireland may not be subject to Irish tax. This is called the remittance basis. It can be extremely valuable — but it has to be structured properly.
